Reuters reports that some midterm election races may take weeks to resolve through recounts and court challenges, with Congress holding constitutional authority as “the judge of the elections, returns and qualifications of its own members.” Election litigation has surged since 2000, with a record 756 cases during the 2023-2024 cycle. Both chambers have established procedures for contested results, with the House having addressed 634 such cases since 1789. MSU law professor Brian Kalt said, “I don’t think it’s a good idea for people to get panicky or alarmist about it. But after January 6, it would be naive to say there’s no potential for shenanigans.”
