The Detroit Free Press reported that the Detroit Tenants Union has sued the 36th District Court, claiming judges allow landlords to collect rent and evict tenants from properties lacking required city safety certifications. Donovan McCarty, director of MSU’s College of Law Housing Justice Clinic and attorney for the tenants’ group, said, “The place where this is failing, is the court.” Only 14% of Detroit rental properties currently have an active certificate of compliance. McCarty said allowing “that kind of lawlessness to continue” means the compliance problem “will never be resolved.” The court declined to comment on pending litigation.
